These Terms of Use ("Terms") govern your access to and use of the ENDIA FLOW mobile application operated by Nascimento e Memolo Desenvolvimento de Programas de Computador Ltda ("we", "us", or "ENDIA FLOW").
By downloading, accessing, or using the App, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the App.
If you are under 18, you should use the App only with the involvement and consent of a parent or legal guardian, where required by applicable law.
2. The Service
ENDIA FLOW is a mobile application that provides short sensory experiences designed to help users notice their internal state and return to presence.
The experience may be informed by wearable signals, a simple check-in, and, when authorized, camera-based heart rate measurement.
ENDIA FLOW is designed as a sensory self-awareness and return experience. It does not provide medical advice, diagnosis, treatment, or emergency assistance.
3. Accounts
To use certain features of the App, you must create an account using Google Sign-In.
You are responsible for maintaining the security of your account and for all activity that occurs under it.
4. Free Trial and Billing
Some plans may include a free trial period, subject to eligibility rules defined by Google Play or Apple App Store, when applicable.
After the trial period ends, the applicable subscription fee will be charged through your app store account unless you cancel before the trial expires.
Free trial eligibility is determined by the applicable app store and may be available only once per user or store account.
5. Subscriptions and Cancellation
Paid features are offered through auto-renewing subscriptions processed by Google Play or Apple App Store, when applicable.
You can manage or cancel your subscription at any time through the respective store settings.
Deleting your ENDIA FLOW account does not automatically cancel an active subscription.
If you cancel a subscription, access may continue until the end of the current billing period, according to the applicable store rules.
6. No Medical or Emergency Use
ENDIA FLOW is a sensory experience tool.
It is not a medical device and does not provide medical advice, diagnosis, treatment, cure, prevention, or emergency assistance.
The App is not intended for use in crisis situations or as a substitute for professional medical, psychological, therapeutic, or emergency care.
If you believe you may be experiencing a medical or psychological emergency, seek appropriate professional help immediately.
7. Acceptable Use
You agree not to:
- Reverse engineer, modify, copy, or interfere with the App
- Attempt to bypass subscription, payment, or access controls
- Use the App for any unlawful purpose
- Share your account credentials with others
- Use the App in a way that may damage, disable, or impair the service
8. Intellectual Property
All content, design, sound, software, trademarks, names, logos, and visual elements in the App are owned by Nascimento e Memolo Desenvolvimento de Programas de Computador Ltda or its licensors.
You may not copy, modify, distribute, reproduce, or create derivative works from any part of the App without prior written permission.
9. Changes to the Service and Terms
We may update the App, its features, pricing, plans, or these Terms from time to time.
When required by law, store policy, or the nature of the update, we may request your acceptance of updated Terms.
Continued use of the App after changes become effective may constitute acceptance of the revised Terms.
10. Availability
We work to keep the App available and functioning properly, but we do not guarantee uninterrupted, error-free, or permanent availability.
Some features may depend on third-party services, device permissions, wearable compatibility, Health Connect, Google Play, Apple App Store, RevenueCat, or Firebase.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business opportunity arising out of or related to your use of the App.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
12. Termination
We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that may harm the service, other users, or our rights.
You may delete your account at any time.
13. Governing Law
These Terms are governed by the laws of Brazil, without prejudice to any mandatory consumer protection rights that may apply in your country or region.
